4x4 Rental with Local Driver in Kyrgyzstan for Tours & Expeditions

The Client and all authorized drivers must:
• Be at least 24 years of age (or the minimum age specified for the selected vehicle category);
• Hold a valid driving licence;
• Have at least two (2) years of driving experience;
• Present an International Driving Permit (IDP) when recommended or legally required.
For mountain routes, remote regions, gravel roads, and cross-border expeditions, previous mountain or off-road driving experience is strongly recommended.
The Client is responsible for honestly informing Mars Travelstan about their driving experience before the rental period.
Mars Travelstan reserves the right to refuse a rental if these requirements are not met.

Only drivers listed in the Car Rental Agreement are permitted to operate the Vehicle.
The Primary Driver assumes full legal and financial responsibility for the Vehicle throughout the rental period, regardless of which authorized driver is operating it.
Any damage, fines or violations caused by an authorized driver remain the responsibility of the Primary Driver.

A reservation is confirmed only after receipt of the agreed deposit or prepayment.
Unless otherwise agreed in writing, the full rental amount must be paid before or at vehicle handover.
Accepted payment methods include:
• Bank Transfer
• Cash
• Credit/Debit Card (if available)
• Other methods approved by Mars Travelstan

A refundable Security Deposit is required for every rental. The standard refundable Security Deposit starts from 500 EUR and may vary depending on vehicle category, rental duration, destination, and selected insurance option.
The Security Deposit may be used to cover:
• Vehicle damage
• Traffic fines
• Parking violations
• Missing accessories
• Lost or damaged camping equipment
• Lost or damaged additional vehicle equipment
• Excessive cleaning
• Administrative expenses
• Vehicle recovery costs
• Any unpaid rental charges
The deposit is normally released within twenty-one (21) business days after completion of the rental and final inspection.

Before departure, Mars Travelstan and the Client will complete a joint vehicle inspection.
Photos and videos of the vehicle condition, mileage, fuel level, documents, accessories, and additional equipment will be recorded.
By accepting the Vehicle, the Client confirms that the Vehicle has been inspected and received in good technical and visual condition.
Any damages or issues noticed before departure must be reported before starting the trip.

The Client agrees:
• To comply with all traffic laws and regulations;
• To operate the Vehicle responsibly and safely;
• To perform reasonable daily checks of tires, fuel and warning indicators;
• Not to overload the Vehicle;
• Not to use the Vehicle for racing or competitions;
• Not to transport dangerous goods;
• Not to use the Vehicle for illegal activities.

Driving in Kyrgyzstan involves mountain roads, gravel roads and remote regions.

Permitted:

• Asphalt roads

• Public gravel roads

• Standard mountain roads

Restricted without prior written approval:

• Remote alpine areas

• Unmarked tracks

• Difficult off-road terrain

Strictly prohibited:

• River crossings

• Rock crawling

• Extreme off-road driving

• Driving outside marked roads

• Driving during dangerous weather conditions

Damage resulting from prohibited use is not covered by insurance.

Driving in Kyrgyzstan includes high mountain passes, remote valleys, river crossings, and areas with rapidly changing seasonal conditions. Some roads may become dangerous due to damaged bridges, landslides, snow, deep mud, or lack of proper road infrastructure.
Without prior written approval from Mars Travelstan, driving is strictly prohibited on the following routes:
• Tosor Pass – hazardous off-road terrain
• Altyn-Arashan Valley (Ak-Suu Gorge) – restricted mountain road
• Karakol Gorge – after the last bridge
• Chatyr-Kol – Kel-Suu road – difficult terrain and seasonal bridge conditions
• Kel-Suu Lake final difficult off-road section (after permitted parking area / yurt camp)
• Enilchek Valley (after Mayda-Adyr Base Camp) – deep river crossings and limited road access
• Kok-Airyk Pass – no official vehicle road (map navigation error)
• Ton Pass – no official vehicle road (map navigation error)
• Karkara Valley (after base camp) – deep river crossings and limited access
• Sary-Jaz Valley – hazardous off-road terrain
• Kyzyl-Oi – Toluk Road – hazardous off-road terrain
• Turasu Valley – deep river crossings and limited access
• Aksu Gorge
• Ak-Shyyrak Village area
• Burhan Pass – Arabel area
• Terek Pass
• Kegeti Pass / Upper Gorge
Mars Travelstan reserves the right to update this restricted route list according to seasonal road conditions, weather, safety information, and local accessibility.
The Client must contact Mars Travelstan before entering any remote, uncertain, or extreme mountain routes.

Violation of restricted route rules may result in:
• Immediate termination of the rental agreement;
• Full loss of the Security Deposit;
• Full financial responsibility for vehicle damages;
• Full responsibility for towing, recovery, rescue, and transportation costs.
Damage caused by prohibited routes, unauthorized river crossings, extreme off-road driving, or ignoring Mars Travelstan route recommendations is not covered by insurance or the Optional Vehicle Damage Protection Package.

The Vehicle may not leave the Kyrgyz Republic without prior written authorization issued by Mars Travelstan.
Unauthorized cross-border travel constitutes a material breach of the Agreement and may result in:
• Termination of the rental;
• Loss of Security Deposit;
• Full financial liability;
• Additional recovery and administrative charges.

All rental vehicles provided by Mars Travelstan are covered by Mandatory Third-Party Liability Insurance (OSAGO) in accordance with the legislation of the Kyrgyz Republic. OSAGO is a mandatory Kyrgyz third-party liability insurance similar to basic liability insurance in many countries.
10.1 Mandatory Third-Party Liability Insurance (OSAGO)
OSAGO is included in the rental price at no additional cost.
OSAGO covers:
• Civil liability of the driver for damage caused to third parties;
• Damage caused to third-party vehicles;
• Damage caused to third-party property;
• Bodily injury or death of third parties, within the limits established by the applicable legislation of the Kyrgyz Republic.
OSAGO does NOT cover:
• Damage to the rental vehicle;
• Tires, wheels and windshield;
• Roof, underbody and interior damage;
• Water or flood damage;
• Engine or mechanical damage caused by negligence or improper operation;
• Damage resulting from prohibited routes or off-road driving;
• Damage caused while driving under the influence of alcohol or drugs;
• Wrong fuel usage;
• Loss of vehicle keys, documents or licence plates;
• Personal belongings left inside the vehicle.
The Client remains fully responsible for all damage or loss not covered by OSAGO insurance.

For additional peace of mind, Mars Travelstan offers an Optional Vehicle Damage Protection Package.
This protection is not mandatory and may be purchased at the Client’s sole discretion before the start of the rental period for an additional fee.
The cost of Optional Vehicle Damage Protection Package starts from 20,000 KGS (approximately 200 EUR) per rental period and may vary depending on the vehicle model, production year, engine size, vehicle value, rental duration, and selected protection conditions.
Optional Vehicle Damage Protection Package may cover:
• Accidental damage to the rental vehicle;
• Collision damage;
• Minor body damage and scratches;
• Windshield and side window damage;
• Headlights and taillights;
• Damage caused by unidentified third parties while the vehicle is properly parked.
Optional Vehicle Damage Protection Package does NOT cover:
• Driving under the influence of alcohol or drugs;
• Unauthorized drivers;
• River crossings;
• Driving on prohibited or restricted routes without approval;
• Extreme off-road driving;
• Water or flood damage;
• Engine damage caused by negligence or improper operation;
• Transmission damage caused by negligence or improper operation;
• Damage caused by incorrect fuel;
• Ignoring dashboard warning lights or continuing to drive with vehicle problems;
• Intentional damage or gross negligence;
• Loss of keys, vehicle documents, licence plates or equipment;
• Personal belongings;
• Any violation of these Terms & Conditions or the Car Rental Agreement.
Mars Travelstan reserves the right to refuse coverage where the Client has acted negligently, improperly operated the Vehicle, or violated applicable laws or rental conditions.

By signing the Car Rental Agreement, the Client confirms that the available insurance options have been explained, that the Client understands the scope and limitations of each option, and freely chooses whether or not to purchase the Optional Vehicle Damage Protection Package.

Regardless of the selected insurance option, the Client agrees:
• To operate the Vehicle responsibly and in accordance with the laws of the Kyrgyz Republic;
• To immediately report any accident, theft or damage to Mars Travelstan;
• To cooperate with police, insurance companies and Mars Travelstan during the claims process;
• To provide all requested documents and information related to the incident.
Failure to comply with these obligations may result in full financial liability for all resulting losses and damages.

In case of an accident, theft or damage, the Client must:
Stop immediately;
Ensure personal safety;
Contact emergency services if necessary;
Notify Mars Travelstan immediately;
Take photographs and videos;
Obtain a police report where applicable;
Follow instructions provided by Mars Travelstan.
Failure to follow this procedure may result in full financial liability.

The Vehicle must be returned with the same fuel level recorded at pickup.
If returned with less fuel, Mars Travelstan reserves the right to charge:
• Fuel cost;
• Refueling service fee.

Unless otherwise specified:
Included mileage: Unlimited (unless otherwise specified in the Car Rental Agreement)
Although mileage is unlimited, Mars Travelstan recommends driving approximately 300 km per day, especially on mountain, gravel, and remote routes, for vehicle safety and comfortable travel.

The Vehicle must be returned:

• On the agreed date and time;

• At the agreed return location;

• In clean condition;

• With the same fuel level as recorded at pickup;

• With all provided documents, accessories and equipment;

• In the same technical and visual condition as received.

Late Return Charges

Delay up to 1 hour: No charge

1–3 hours: 10 EUR per additional hour

More than 3 hours: Full rental day charge

Delay exceeding 24 hours without notification:

Mars Travelstan reserves the right to take necessary actions to recover the Vehicle and may report the Vehicle as unlawfully retained.

A joint vehicle inspection will be completed upon return, including photographs and videos if necessary.
Any new damage, missing equipment, excessive dirt, unpaid charges, or violations may be deducted from the Security Deposit according to these Terms & Conditions.

The following charges apply only if damage, loss, or additional costs are caused by the Client’s negligence, misuse of the vehicle, violation of rental conditions, or improper operation.
These amounts may be deducted from the Security Deposit.
If the actual repair or replacement cost is higher than the listed amount, or additional hidden damage is found during inspection or repair, the Client remains responsible for the additional costs.
Damage caused by prohibited routes, river crossings, careless driving, wrong fuel usage, ignoring warning lights, or improper vehicle use is not considered normal wear and remains the responsibility of the Client. If the Vehicle cannot be used due to damage caused by Client negligence, accident, prohibited use, or violation of these Terms & Conditions, the Client may be responsible for vehicle downtime costs.
Vehicle downtime may be charged according to the daily rental rate until the Vehicle is repaired and available for rental again.

Mars Travelstan provides vehicles in good technical condition. All vehicles are inspected and prepared before every rental.
Mars Travelstan is responsible for providing assistance in case of mechanical failure caused by normal vehicle use and not related to the Client’s negligence, misuse, accident, prohibited routes, or violation of the rental conditions.

Client Responsibility Exceptions
The following situations are not considered normal mechanical failure and remain the Client’s responsibility:
• Damage caused by accidents;
• Damage caused by prohibited routes;
• Extreme off-road driving;
• River crossings or water damage;
• Wrong fuel usage;
• Ignoring dashboard warning lights;
• Continuing to drive with overheating or oil problems;
• Driving with unusual noises or obvious mechanical problems;
• Improper vehicle operation.
The Client must immediately stop driving and contact Mars Travelstan if any warning lights, overheating, unusual noises, oil issues, or mechanical problems appear.
If the Client continues driving after a warning sign or ignores vehicle problems, any resulting damage and additional repair costs become the Client’s responsibility.
Vehicle replacement depends on location, road conditions, availability of replacement vehicles, and other operational circumstances. Mars Travelstan will make every reasonable effort to provide a replacement vehicle in case of unexpected mechanical failure.

Vehicles are equipped with GPS tracking devices for:
• Vehicle security;
• Theft prevention;
• Emergency assistance;
• Fleet management;
• Route monitoring and restricted area control.
GPS and personal data are processed solely for operational, security and legal purposes and will not be disclosed to third parties except where required by law or insurance procedures.

Mars Travelstan shall not be responsible for delays, route changes, or service interruptions caused by circumstances outside the Company’s control, including:
• Severe weather conditions;
• Landslides or road damage;
• Floods or natural disasters;
• Road closures;
• Government restrictions;
• Border closures or permit restrictions;
• Civil disturbances;
• Other force majeure events.
No refund or compensation shall be provided for unused rental days, delays, or additional expenses resulting from force majeure events or circumstances beyond the control of Mars Travelstan.

Late cancellation: The reservation deposit is non-refundable unless otherwise agreed in writing.
Early return: Unused rental days are non-refundable.

All optional services are subject to availability and must be requested in advance.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Kyrgyz Republic.
Any dispute arising from the rental shall be subject to the exclusive jurisdiction of the competent courts of the Kyrgyz Republic.

• The Client has received the Car Rental Terms & Conditions;
• The Client has carefully read and fully understood all terms before signing;
• All rental rules, restrictions, responsibilities, fees, and charges have been clearly explained;
• The Client understands the insurance coverage, limitations, and personal responsibilities;
• The Client accepts the Vehicle Use Policy, Restricted Routes Policy, Damage Policy, and Security Deposit conditions;
• The Client agrees to follow all instructions provided by Mars Travelstan regarding safe vehicle operation;
• The Client confirms that the Vehicle was inspected before departure and received in good working condition;
• The Client agrees to comply with all policies established by Mars Travelstan.
By signing this document, the Client accepts these Terms & Conditions and agrees to be legally responsible for complying with them during the entire rental period.
